Natalia Merino Moreno is an associate in the Mexico City office of Ogletree Deakins. She advises all types of employers nationally and internationally on various aspects of employment relations in Mexico. Additionally, she has experience in Human Resources, as prior to joining Ogletree Deakins, she worked in the Human Resources area at Costco Wholesale in Mexico. Natalia speaks Spanish and English.

Counseling, Investigations and Training

Natalia assists in-house counsel, HR professionals, and business leaders with (amongst others):

  • Compliance with Mexican Federal Labor Law, Social Security Law and Mexican Official Standards (Normas Oficiales Mexicanas or NOMs for its acronym in Spanish).
  • Day-to-day operations and employment matters, with focus on its commercial and human resources impact.
  • Preparation and review of all kinds of employment related documents, such as agreements, internal work regulations, work policies and codes of conduct
  • Employment termination processes, from determining appropriate course of action, through calculating estimated amounts for severance and preparing required documents and up to the execution and formalization of said processes.
  • Handling matter before Mexico’s Social Security Institute (IMSS), from obtaining the registry before said authority, through issuing and handling disability/leave certificates.
  • Workplace investigations with special focus on compliance, workplace environment and identification of possible harassment.
  • Conducting trainings for HR and leadership teams.
  • Garnishments.
  • Labor inspections from Mexico’s Labor Ministry.

Litigation

Natalia has experience in litigation before Mexico’s Social Security Institute (IMSS) and Administrative Courts. Some of her work on said regards includes:

  • Appealing IMSS’ resolutions and fines regards employer’s quota payments.
  • Appealing Tax credits imposed by the IMSS.
  • Appealing Labor Ministry resolutions and fines on labor inspections procedures.

Health and Safety

Natalia assists employers not only with ensuring compliance of Mexican Official Standards, but also on the creation and implementation of Health and Safety programs and trainings.
