David E. Leal González advises and represents employers on a broad range of labor, employment, social security, and labor-related administrative law matters in Mexico. He has extensive experience counseling domestic and multinational companies on complex employment matters, collective labor relations, regulatory compliance, and proceedings before labor and social security authorities. David has significant experience in collective labor matters and represents employers in connection with collective bargaining agreements, strike proceedings, and other union-related matters. He regularly advises clients on negotiations with unions, including collective bargaining agreement revisions, labor restructurings, and the termination of collective labor relations. He also assists employers with the preparation and implementation of employment agreements, confidentiality agreements, workplace policies, and other labor-related documentation.
David advises employers on individual and collective terminations, hiring procedures for confidential and unionized employees, employment conditions, compensation and benefit structures, and preventive labor compliance. He regularly conducts labor audits and due diligence reviews and represents employers in individual employment litigation. David also has substantial experience in social security matters, advising employers on compliance with their obligations before the Mexican Social Security Institute (IMSS) and conducting preventive reviews and audits to identify and mitigate social security risks. He represents employers in the administrative and judicial challenge of assessments, fines, determinations, and other administrative and tax-related acts issued by the IMSS. David also has extensive experience in labor-related administrative law and regulatory compliance. He advises employers in connection with inspections and administrative proceedings conducted by federal and local labor authorities, including the Mexican Ministry of Labor and Social Welfare (STPS). His practice includes counseling companies on compliance with labor, occupational health and safety, and workplace regulatory obligations; assisting employers throughout inspection proceedings; and challenging fines, sanctions, and other administrative acts initiated or imposed by labor authorities.
